Generally construction loans are for the duration of the construction phase. After the occupancy permit is signed off by the building inspectors, the bank releases the last of the money to the contractor and subcontractors.

The principal and interest that accrued during construction are then rolled into one lump sum and becomes the principal due on a new loan with a fixed or variable rate. You will be given a closing date for the new loan and a regular payment schedule.

A mortgage is a legal document stating a secured interest in real property, typically a person's home. A second mortgage loan refers to a home loan that is second in line in the event of foreclosure or sale of the property. Essentially among the secured mortgage lenders, the second mortgage holder stands behind the first mortgage holder and any liens filed against the property prior to the filing of the 2nd mortgage.

Second mortgage loans can be taken out for a variety of uses, such as debt consolidation and home improvements. These loans are often at a higher rate than first mortgages as they represent a greater risk for the home mortgage lender. But, the interest rate can also be affected by other factors (other than current market conditions), the most likely being:

  • The borrower's credit history.
  • The CLTV (combined loan to value). This is the percentage of the home's value that has been borrowed against. For example: Having a first mortgage of $75,000 and a second of $15,000 borrowed against a house valued at $100,000 is 90% ($90,000 divided by $100,000).

Title Opinion is a written statement from an attorney which describes the quality of title to a property. It gives an analysis of the title search regarding the current ownership rights in the property. It states whether there is any kind of lien or cloud in the title to the property.

Purpose of the Title Opinion

The title opinion describes the property, provides the names of the owners and any exception that the attorney has discovered to the title. Such exceptions include recorded building restrictions, servitudes, and building set-back lines. The opinion is issued on the basis of the information provided in the public records of the parish in which the property is situated.

A title Opinion states whether a property has any mortgage or lien against it. But if the attorney says that, there is no such lien and it happens that there is such a defect in the title, then he has to fix up the problem. The attorney then has to get rid off the problem at his expenses. He may even have to pay off the mortgage or judgment. Thus, title opinion is a low-cost insurance policy that lasts for as long as the attorney is legally responsible to resolve any problem he overlooked. The obligation is limited to the time frame that an attorney can be sued for malpractice.

Title Commitments/Binders

During the real estate purchase process, the title company will search the public records, and issue what is called a title insurance commitment or a title insurance binder. Along with certain property, buyer, and lender information, this document will likely have a list of requirements and exceptions.

This document binds the title company to issue the insurance policy subject to the requirements being met. The list of exceptions are those items that will not be covered by the insurance policy.

The opportunity to protect hard earned equity in the sale of an investment has been available to consumers since 1921. However, complexities and details of the tax code prevented only the most knowledgeable from using this option. In 1990 the Omnibus Budget Act clarified the process an opened this option to a broader set of consumers

Section 1031 Exchanges, which have become more popular since the mid-90s, allow investors to defer the tax on capital gains until some point in the future.

Section 1031 of the Internal Revenue Code provides that no gain or loss shall be recognized on the exchange of property held for productive use in a trade or business, or for investment. A tax-deferred exchange is a method by which a property owner trades one or more relinquished properties for one or more replacement properties of "like-kind", while deferring the payment of federal income taxes and some state taxes on the transaction.

The theory behind Section 1031 is that when a property owner has reinvested the sale proceeds into another property, the economic gain has not been realized in a way that generates funds to pay any tax. In other words, the taxpayer's investment is still the same, only the form has changed (e.g. vacant land exchanged for apartment building). Therefore, it would be unfair to force the taxpayer to pay tax on a "paper" gain.

The like-kind exchange under Section 1031 is tax-deferred, not tax-free. When the replacement property is ultimately sold (not as part of another exchange), the original deferred gain, plus any additional gain realized since the purchase of the replacement property, is subject to tax.

A Qualified Intermediary (QI) is the professional provider of the mandatory mechanics of an exchange. The use of a QI, as an independent party to facilitate a tax-deferred exchange, is a safe harbor established by the Treasury Regulations. Sometimes QI's are referred to as "accommodators" or "exchange facilitators."

When the taxpayer engages the services of a QI, pursuant to an exchange agreement, the IRS does not consider the taxpayer to be in receipt of the funds. The sale proceeds go directly to the QI, who holds them until they are needed to acquire the replacement property. The QI then delivers the funds directly to the closing agent who deeds the property directly to the taxpayer.

Without a QI, and pursuant to an exchange agreement, the IRS may not define a transaction as an exchange, thereby making it ineligible for tax deferment status.
